Governor Andrew Cuomo clearly was quoted saying, “I am disabled” yet as a disabled person in New York State living in state or private facilities and group homes he himself in most cases would be denied 911 services if he were a victim of a physical and sexual assault crime, if he was in medical distress or died. Governor Cuomo also would also in most cases be denied his Constitutional right to be protected by all of the same laws as everyone else benefits. Denying anyone equal protection of laws is considered discrimination in civil rights.

For many years Governor Cuomo and his lawyers in the Governors Counsel’s office have ignored the most basic rights for disabled New York State residents to 911 emergency call systems and emergency medical and police first responder services. It is hard to fathom anyone would direct such discriminatory and deadly civil rights violations against the most vulnerable, but Governor Cuomo has done so for years. As New York State’s Attorney General and as Governor, Cuomo has taken dramatic steps also to ensure that the disabled are denied their U.S. and New York State Constitutional right to “equal protection of laws.” Cuomo was clearly being nothing more than a politician seeking national attention when he made this statement, “As a New Yorker I am a Muslim. As a New Yorker, I am Jewish. As a New Yorker, I am black, I am gay, I am disabled, I am a woman seeking to control her health and choices,” Cuomo said Sunday, “because as a New Yorker, we are one community – the New York community comprised of all of the above.”

The disabled are being treated unequally and as far lower class residents of New York State and citizens of the United States, which must be stopped. These individuals are being denied these equal rights;

• U.S. Constitution -14th Amendment right to equal protection of laws
• NYS Constitution- Section 11 of Article 1 of the Bill of Rights- equal protection of laws
• Equal protection of laws and equal access to emergency 911 call systems and first responder medical and police assistance and services when they are victims of physical and sexual assault crimes, significantly injured, in medical distress or died
• Equal protection of laws and equal access to justice due to the fact that most reported crimes against these vulnerable individuals are kept from being reported to local police and purposely kept from being criminally investigated.
• Equal protection of laws and equal access to justice due to the fact that most witnessed and reported criminal cases cannot be prosecuted due to purposeful lack of evidence collection and retention.
• Equal protection of laws and equal access to justice due to the fact that most of these reported and witnessed crimes are never reported to County elected District Attorney’s.
• Equal protection of laws and equal access to justice due to the fact that most reported and witnessed crimes will never be looked at through NYS penal law statutes as for other State residents, but instead four different internal categories are being used that all rise to the level of felony criminal offenses according to NYS penal law. Thousands of clear crimes kept from prosecutions to protect the perpetrators and criminals and deny equal protection of laws for the person with the disability. These actions allow the criminals to remain employed, off the abuse registry and able to re-victimize the same and other innocent extremely vulnerable victims.
• Equal protection of laws and equal access to justice due to the fact that their criminal cases are purposefully kept from, and almost always never, go through the normal criminal justice system and local courts.
• Equal protection of laws because the Justice Center for the Protection of People with Special Needs is not a first responder entity. This State entity ensures the Obstruction of Justice.
• Equal protection of laws because the Justice Center for the Protection of People with Special Needs is keeping most criminally negligent deaths or possible criminally negligent deaths from County Medical Examiners or Coroners, as well as from County elected District Attorney’s as required by law.
• Equal protection of laws because the Justice Center for the Protection of People with Special Needs Special Prosecutor is not an elected official, but a State employee who is not independent from the agencies involved, this is a direct conflict of interest.
• Equal protection of laws because the Justice Center for the Protection of People with Special Needs Special Prosecutor is operating unconstitutionally bypassing County elected prosecutors which have authority.
• Equal protection of laws because the Justice Center for the Protection of People with Special Needs is withholding thousands of criminal cases that were substantiated from being reported to the Office of Medicaid Inspector General as required by law. These illegal practices ensure the protection of dangerous facilities and dangerous staff and administrators involved in the original crimes or the crimes of covering-up the rapes, physical assaults and deaths. These are also matters that constitute a clear criminal conspiracy and Medicaid fraud.

Duke Endowment Weighs in to Help NC Children in Crisis

GREENSBORO, NC, USA, January 26, 2017 /EINPresswire.com/ — Children’s Home Society will receive support from a long-term ally to help scale up proven programs to battle North Carolina’s foster care crisis. Among a growing list of concerned organizations and individuals, The Duke Endowment announced a 4-year, $3.7-million grant to expand foster care, early intervention, and prevention services across the state.

“James B. Duke set a course for his philanthropy to enrich lives in a multitude of ways across North and South Carolina,” said Phil Redmond, Jr., Director of The Duke Endowment’s Child Care program area. “Today, we continue our journey together with Children’s Home Society of North Carolina to help vulnerable children lead more successful lives.”

According to Brian Maness, President and CEO of Children’s Home Society of North Carolina, foster care is in a state of crisis, increasing every month in 2016 compared to the same period in the prior year.

At the end of 2016, there were 10,524 children in foster care with about 2,400 children eligible for adoption.

“Last year, we were able to place only 12 percent of the children referred to us,” said Maness. “We need to increase public awareness of the foster care crisis and expand our capacity of adoptive and foster homes for children.”

Committed to reversing these negative trends, the leadership and board of Children’s Home Society – North Carolina’s largest provider of foster care and adoption services – launched the Promise of Family campaign, teaming resources from foundations, companies, organizations, families and individuals to expand and accelerate proven programs for vulnerable children.

“A child without a family is unacceptable,” said Maness. “Every child deserves a loving, safe, and permanent home.”

According to Maness, the relationship between the Duke family and Children’s Home Society of North Carolina goes back to 1902, when Benjamin Duke, the brother of James Buchanan Duke, founder of The Duke Endowment, was on the founding CHS board.

“One hundred fifteen years later,” said Maness, “Children’s Home Society’s core mission of promoting a loving, safe, and permanent family for every child has not changed.

The Duke Endowment, based in Charlotte, has distributed more than $3.3 billion in grants since its inception in 1924. The endowment’s work in North Carolina and South Carolina focuses on child care, health care, higher education, and rural United Methodist churches.

Founded in 1902, Children’s Home Society serves over 20,000 children and families in all 100 counties in North Carolina with adoption, foster care, parenting education, family preservation, and teen pregnancy prevention services. More than 15,000 children have been adopted through Children’s Home Society North Carolina.

Governor Cuomo has known of the wide-scale discrimination and unsafe care of the disabled since he was the Attorney General and throughout his entire time as Governor of New York State, yet 7,000 calls continue to go to his abuse hotline for the disabled on average every month. The 911 emergency call systems are almost always bypassed. The physical and sexual abuse, neglect and death of the disabled in New York State is rampant and nothing significant is being done to stop it and everything imaginable is being done to circumvent 911 call systems, local authorities, laws, County elected District Attorney’s, Medical Examiners and Coroners, as well as local courts. It is as if the disabled are not really human beings, it is that bad. At the same time this is going on Governor Cuomo invokes Dr. Martin Luther King Jr. and his crusade for justice not being over in an attempt to move to help another group of people that he favors. It is very interesting that on the same day my letter titled, “Clean your own house, gov” http://www.nydailynews.com/opinion/jan-16-waldorf-politics-paris-article-1.2946199 (towards bottom) was two pages over in the Daily News Newspaper. Governor Cuomo is ignoring the rights and immediate safety, health and lives of upwards of 1,000,000 New Yorkers with disabilities. It is both outrageous and appalling that the disabled are being such victims of discrimination and civil rights violations still in 2017. The same emotions exist regarding Governor Cuomo’s attempts to move on to help another group of people that are nowhere near as vulnerable as the disabled that are living in known unsafe and extremely dangerous and deadly facilities and group homes under Governor Cuomo’s control. Governor Cuomo cannot continue to look the other way regarding the discrimination and atrocities occurring against the disabled, 5-6% of New York State residents, when he can take decisive actions to stop what Dr. Martin Luther King Jr. would be horrified over.
It is the disabled that can no longer be treated unequally and denied emergency 911 first responder services and their basic constitutional right to equal protection of laws. We must work together to end this gross injustice and discrimination against our most vulnerable. We must prevent the further loss of precious innocent lives and ensure that 911 is no longer bypassed for our disabled. We as a civil society cannot sit by and allow this evil and the purposeful denial of equal protection of laws to continue any longer, it is without question discrimination in civil rights.
