Renowned International Law Experts Recommend International Criminal Court (ICC), if Sri Lanka continues to Fail to Act

In a Press Conference held in Geneva within hours of Sri Lankan Foreign Minister Mangala Smaraweera’s address to the UN Human Rights Council, a group of well renowned international Law experts recommended Sri Lanka be referred International Criminal Court (ICC), ”if Sri Lanka continues in bad faith and/or fail to take significant steps towards implementing the word and spirit of the UN Human Rights Council Resolution 30/1, including establishing a hybrid war crimes court with the participation of international judges and prosecutors.”

The group Monitoring and Accountability Panel (MAP), was established to monitor Sri Lanka’s compliance to the UN Human Rights Council Resolution 30/1, which Sri Lanka itself co-sponsored.

Based on the documented events of the last twelve months, the MAP has come to the following conclusions:

1) The Government of Sri Lanka is not acting in good faith with respect to its commitments under the UN Human Rights Council Resolution 30/1;

2) Human Rights violations and abuses amounting to crimes under international law continue to be committed in Sri Lanka with impunity;

3) Key reforms to the country’s justice and security sectors have failed to materialize; and

4) The initial reaction of the Government of Sri Lanka to the Final Report of the Consultation Task Force on Reconciliation (CTF) appointed by the Sri Lankan Government itself amounts to a cynical and reckless repudiation of the stated aspirations of Sri Lanka’s citizens.

The Governor in his own words clearly left out the disabled because once I brought to his personal attention and to the public’s attention that he is not fighting for the disabled and their basic equal rights to 911 emergency medical and police services or fighting for their equal protection of laws. Governor Cuomo truthfully had to remove his statement that “I am disabled.” Here is the direct quote from the CBS news story http://newyork.cbslocal.com/2017/01/29/cuomo-travel-ban-hotline/ “As a New Yorker I am a Muslim. As a New Yorker, I am Jewish. As a New Yorker, I am black, I am gay, I am disabled, I am a woman seeking to control her health and choices,” Cuomo said Sunday, “because as a New Yorker, we are one community – the New York community comprised of all of the above.”

Tragically the disabled are excluded and are grossly discriminated against treated as far lower class residents of New York State. It is not politically correct for the governor to ensure the protection of people with disabilities. This is no joke; thousands of people with disabilities are sexually assaulted and dying within New York State’s extremely dangerous mental health care system every year and Governor Cuomo is looking the other way.

Here is the extremely disturbing quote from this investigative report; “At a home upstate in Hudson Falls, two days before Christmas in 2006, an employee discovered her supervisor, Ricky W. His pants were around his ankles, his hand was on her knee and her diaper was pulled down. The police were called, and semen was found on the victim. New York State documents obtained through Freedom of Information Law (FOIL) reveal staggering numbers of deaths and sexual assaults in these facilities. These massive problems cannot continue to be pushed aside and ignored by the Governor of New York State. Governor Cuomo has claimed publicly saying “I am disabled” http://newyork.cbslocal.com/2017/01/29/cuomo-travel-ban-hotline/ which is obviously not true, but he was using it, along with other statements, to say that he is fighting for people with disabilities and their rights, which also sadly not true.
The shear staggering numbers of reported deaths and sexual assaults in these State and private facilities and group homes throughout New York State speak volumes. The truth is, we have severe systemic failures and very ugly things are happening behind these closed doors and many innocent and extremely vulnerable people with disabilities are dying and being raped as a result. State documents reveal that 11-12 deaths on average are reported a day and 1,300 sexual assaults within the Office of People with Developmental Disabilities (OPWDD) system alone on average every year or close to four a day. Most of the deaths are covered-up because Governor Cuomo’s Justice Center is not notifying County elected District Attorney’s and Medical Examiners or Coroners of most of these deaths. It is hard to fathom that they continue to get away with this evil and these crimes as I continue to expose it and shout it from the rooftops, but hopefully it will be stopped soon.
In regards to sexual assaults, the numbers exponentially increase when we look at the full reality and fact that almost all of these sexual assault crimes against these disabled victims, that in most cases cannot speak or defend themselves, will never be witnessed or reported. A well known report titled “Prevalence of Violence” http://www.mass.gov/dppc/abuse-recognize/prevalence-of-violence.html has been up on the State of Massachusetts website for a long time, brings an even more powerful fact to light, which is a horrible fact that only 3% of these sexual assaults and rapes of the developmentally disabled will ever be reported. Using this statistical data along with the known New York State numbers of reported sexual assaults could mean that approximately one third of the developmentally disabled living in State and private facilities within the OPWDD system alone are sexually assaulted on average once a year. Sexual abuse and rape of the disabled in these facilities is a massive problem which has been known by Governor Cuomo for many years. Most deaths and sexual assault crimes of New Yorkers with disabilities living in known unsafe residential care facilities and group homes are swept under the rug and covered-up by Cuomo’s fraudulent Justice Center.
There are basic safety and abuse prevention measures that will make the system much better and safer and dramatically reduce the staggering numbers of deaths and sexual abuse crimes occurring in these facilities, but Governor Cuomo has refused to take action. Surveillance cameras must finally be installed within all mental health facilities and group homes, as well as all transport vehicles, this is vital to prevent these deaths, crimes and to hold sexual predators accountable. Immediate and direct reporting by mandated reporters to 911 and not a State whitewash/cover-up entity is not only critical to hold criminals accountable, but will also save many lives. No longer can New York State continue to deny innocent and extremely vulnerable children and adults with disabilities living outside their family’s home 911 emergency first responder medical and police services and assistance, this is discrimination and in many cases it is deadly. Bypassing local authorities, laws in place for everyone and local courts also denies this specific group of people their 14th Amendment right to “equal protection of laws.”

Governor Cuomo has claimed publicly saying “I am disabled” http://newyork.cbslocal.com/2017/01/29/cuomo-travel-ban-hotline/ which is obviously not true, but he was using it, along with other statements, to say that he is fighting for these individuals and their rights which also not true. Governor Cuomo can change and he simply needs to put the money where his mouth is. The shear staggering numbers of sexual assaults speak the truth of what is really going on behind these closed doors, 1,300 reported sexual assaults within the Office of People with Developmental Disabilities (OPWDD) system alone on average every year or close to four a day. When the numbers exponentially increase is when we look at the full reality and fact that almost all of these sexual assault crimes against these disabled victims, that in most cases cannot speak or defend themselves, will never be witnessed or reported. A well known report titled “Prevalence of Violence” http://www.mass.gov/dppc/abuse-recognize/prevalence-of-violence.html has been up on the State of Massachusetts website for a long time, brings an even more powerful fact to light, which is a horrible fact that only 3% of these sexual assaults and rapes of the developmentally disabled will ever be reported. Using this statistical data along with the known New York State numbers of reported sexual assaults could mean that approximately one third of the developmentally disabled living in State or private facilities within the OPWDD system alone are sexually assaulted on average once a year. This is a massive problem that demands massive actions by Governor Cuomo, not what continues, which is sweeping most of these crimes under the rug or in other terms, most are covered-up.
There are basic safety and abuse prevention measures that will make the system much better and safer and dramatically reduce the staggering numbers of sexual abuse crimes and deaths occurring in these facilities, but it will take leadership. Surveillance cameras must finally be installed within all mental health facilities and group homes, as well as all transport vehicles, this is vital to prevent these crimes and to hold sexual predators accountable. Immediate and direct reporting by mandated reported to 911 and not a State whitewash/cover-up entity is not only critical to hold criminals accountable, but will also save many lives. No longer can New York State continue to deny innocent and extremely vulnerable children and adults with disabilities living outside their family’s home 911 emergency first responder medical and police services and assistance, this is discrimination and in many cases it is deadly. Bypassing local authorities, laws in place for everyone and local courts also denies this specific group of people their 14th Amendment right to “equal protection of laws.”
This week’s AP News piece reported on a disgusting case in which a New York State caregiver was molesting a disabled child in a State run group home. Thankfully, there was some measure of justice in this case, but most are being covered-up by Governor Cuomo’s wrongfully named Justice Center which is keeping most reported sexual assault crimes from local police and County elected District Attorney’s. New York State’s system is made up of thousands of State run and privately operated facilities and group homes and the rampant sexual abuse in these facilities can be dramatically reduced. The award winning New York Times “Abused & Used” investigative reporting series which was a runner up for a Pulitzer Prize, exposed New York State’s extremely dangerous and deadly system in 2011. His pants were around his ankles, his hand was on her knee and her diaper was pulled down. The police were called, and semen was found on the victim. But the state did not seek to discipline Mr. Sousie. Instead, it transferred him to work at another home.” Pretty graphic, but this type of evil must come out into the light and dramatic steps must be taken to prevent these horrible sex crimes and rapes of disabled men, women, boys and girls whom are extremely vulnerable and in most cases cannot defend themselves. Bypassing 911 and local police is how New York State currently gets away with covering-up thousands of crimes and deaths annually.
Tragically, these sexual predator cases reported on are a drop in the bucket regarding rampant sexual abuse occurring within New York State’s mental health care system today, which can and must be stopped. Neo-Nazis Again Given Center of Kaunas, Lithuania's Second City, on Nation's Independence Day

VILNIUS, LITHUANIA, February 22, 2017 /EINPresswire.com/ — Close to 200 neo-nazi marchers were again granted the center of Kaunas, Lithuania's second city, on the nation's February 16th independence day, for a march that covered the whole of the city's main thoroughfare, Laisves Aleja (Liberty Boulevard), concluding in the plaza of the historic presidential palace from the interwar period, when Kaunas (also known as Kovno) was the capital of the Lithuanian Republic. This year's independence day marked the 99th anniversary of the rise of independent, democratic Lithuania in 1918 after centuries of domination by the Russian Empire and other invaders.

Kaunas was home to around 30,000 Jews before the Holocaust. Nearly all were murdered by the Nazis and their local collaborators. It was, therefore, particularly painful for the remaining Holocaust survivors in the region, and their families, that the lead banner of the marchers boasted a huge portrait glorifying Kazys Skirpa (Shkirpa), a pro-Nazi figure from that very city who demanded ethnic cleansing of his country's Jewish citizens many months before the Nazi invasion of 22 June 1941. It was as if, one survivor lamented, "the mayor and city council of Kaunas, by giving these guys the most cherished sections of our city on our beloved independence day, are saying that they are quite okay with the city's 30,000 Jews having been murdered."

In an "American twist" this year, the image of Skirpa was made green to resemble Pepe the Frog, a cartoon figure which the Anti-Defamation League added to its data base of hate symbols during the 2016 U.S. presidential campaign. It has been associated particularly with the alt-right movement.

Another huge poster at the Kaunas march proclaimed in Lithuanian and English: “We Jews intend to turn Europe into a mixed race of Asians and Negroes ruled over by the Jews.” An even larger one had a list of 33 Jews who had allegedly worked for the KGB decades ago. Racist posters included a British school room of exclusively white children in the 1950s compared with a multiracial class today with this added information: “In northern England, not London!”

The official human rights organizations in the country were nowhere to be seen. Nore were there any international Jewish organizations on hand to observe the event this year. The only monitors, and silent protesters, were a five-person team from the journal DefendingHistory.com that is based in Vilnius, the capital of Lithuania. Defending History has for years called on the mayor and city council to move the neo-fascist march away from the center of the city on independence day, so as to preserve their free speech without the official stamp of legitimization, or even approval, that comes with enabling such demonstrations in major city centers on a nation's most hallowed day. The statement released reads, in part: “We came to remember the 30,000 murdered Jews of Kaunas on the independence day that they too patriotically marked with love every year. It is shocking that yet again the mayor and city council have gifted the center of the city, including Liberty Boulevard and the plaza of the historic presidential palace, on the cherished independence day, to the neo-nazis who so damage the name of modern, tolerant, democratic Lithuania.”

Observers were relieved that there were fewer marchers than on previous years (in some years the numbers reached into the thousands, but this year's event was preceded by a major split in the neo-nazis' ranks that some observers think may be temporary). There was also praise for the generally balanced media coverage which this year included the voices of protest from the DefendingHistory.com team. There was special praise for the extensive in-depth coverage by The Weekly of Vilnius that is edited by the eminent Egyptian born journalist and public affairs analyst Nehro Khalil.

Eyes are now turning to the nation's second, and equally cherished, independence day, March 11th, commemorating the momentous and daring declaration of independence from the Soviet Union in 1990, a feat that helped little Lithuania play an outsize historic role in the demise of the totalitarian Soviet Union that had occupied and stifled the Baltics since 1940 (with the exception of the Nazi German years, 1941-1944). Since 2008, the mayor and city council of Vilnius, the nation's capital, have allowed a similar neo-nazi march to take over the capital's central thoroughfare, Gedimino Boulevard, and similarly project an official legitimization for racist, antisemitic, xenophobic, homophobic, anti-refugee and racial-superiorist doctrine. The New York Times Editorial Board long ago said it very well, the police need to be involved and surveillance cameras are needed as directly quoted, “There is much the governor could do. He could require surveillance cameras in these facilities, just as prisons have them. So why has Governor Cuomo looked the other way regarding taking the most basic steps to protect the disabled? He told me personally the same day he rolled out his fraudulent Justice Center scheme, he told me that he wanted cameras, but the unions did not. Instead of protecting innocent and extremely vulnerable children and adults with disabilities and those struggling with mental illness, Governor Cuomo chose to protect the unions wishes and their members that are involved in sexual assault crimes, as well as many other types of crimes including criminally negligent homicides.
Governor Cuomo, publicly made a bogus political statement that “I am disabled” in attempts to claim that he fights for the rights of everyone including the disabled in this CBS News story http://newyork.cbslocal.com/2017/01/29/cuomo-travel-ban-hotline/ . The fact of the matter is that this is an outright lie. Governor Cuomo and numerous individuals within his administration have taken no significant actions to stop or prevent most of the sexual assault crimes or deaths of the disabled, but instead the exact opposite. After the New York Times “Abused & Used” investigative reporting series Governor Cuomo and Clarence Sundram along with the provider agencies concocted a scheme to rename and relocate the prior State agency headed up by Sundram for close to 20 years. This agency was called the NYS Commission on Quality of Care & Advocacy for persons with Disabilities (CQC) and it has a history of making almost all reported physical and sexual assault crimes and criminally negligent deaths disappear by keeping most from local police, criminal investigations and from County elected District Attorney’s. The State as documented in writing in their own words calls it their “coherent oversight scheme” and their “carefully cultivated understanding.” The agreement the State of New York has with providers to hide and conceal documents and evidence of crimes to protect them and their employees from litigation. It does not get much clearer than what they have documented which undisputedly constitutes a criminal conspiracy, all surrounding obstruction of justice and Medicaid fraud which are all federal crimes.
The CQC was primarily a cover- up or whitewash entity. So to give an appearance only of reform both Governor Cuomo and Clarence Sundram, whom Cuomo hired back to be his special advisor on vulnerable persons after the first NY Times piece came out worked hard to deceive 1,000,000 New Yorkers with disabilities, their families, the media and the general public. They claimed that they took major steps to protect the disabled, when almost everything they claimed was an outright lie. The cover-up scheme can only be successful by keeping almost all physical and sexual assault crimes, injuries, medical distress situations and deaths of our most vulnerable from the 911 call systems so that independent local police and emergency medical personnel are not notified and not able to respond. So for this scheme to continue, but now on steroids, it had to be renamed and everything from all mental health agencies reported internally to Cuomo’s abuse hotline, instead of 911. This keeps virtually almost everything internal unless released by the State, when they choose to throw someone under the bus. So what continues to date, are quite frankly astronomical atrocities and crimes and cover-ups of these crimes and deaths likened to horrific war crimes. Thousands of reports are called into Governor Cuomo’s wrongfully titled Justice Center abuse hotline every month, over 7000 on average and thousands of deaths as well. New York State has no intention of stopping or preventing most of these horrors, but instead cover-up most. It is critical that federal authorities stop these atrocities and that the federal Medicaid dollars, in the billions annually are finally actually used to provide safe care that is free from abuse and neglect. Immediate and direct reporting by all mandated reporters to 911 is vital, as well as the installation of surveillance cameras in all State and private facilities and group homes and all transport vehicles. These are the most basic common sense protection measures that will dramatically reduce these crimes and cover-ups and end decades of discriminatory and deadly practices that deny the disabled 911 emergency services and their constitutional right to “equal protection of laws.”
